These Cloud Terms of Service ("Cloud Terms") supplement the general Klixsor Terms of Service and apply specifically to the Klixsor Cloud hosting service ("Cloud Service"). By subscribing to a Cloud plan, you agree to these Cloud Terms in addition to the general Terms.
1. Service Description
Klixsor Cloud provides a cloud-hosted instance of the Klixsor traffic distribution software on infrastructure provisioned and maintained by Klixsor. The Cloud Service includes:
- A dedicated virtual private server (VPS) provisioned in your selected region
- Pre-installed and configured Klixsor software
- Automatic software updates delivered at our discretion
- Uptime monitoring with health checks
- SSL certificates for added domains (via Let's Encrypt)
2. Service Level — Best Effort
Cloud instances are provided on a best-effort basis. Uptime is not guaranteed. We do not provide a Service Level Agreement (SLA) for the Cloud Service. While we make reasonable efforts to maintain availability, we do not guarantee any specific level of uptime, performance, or response time.
We are not liable for any downtime, data loss, performance degradation, or service interruptions, including but not limited to those caused by:
- Infrastructure provider (Contabo) outages or maintenance
- Network connectivity issues
- Software updates or migrations
- Security incidents
- Force majeure events
3. Customer Responsibilities — Backups
The customer is responsible for their own data backups. While Klixsor Cloud instances include database systems (PostgreSQL, ClickHouse), we do not guarantee automated backups, backup integrity, or data recovery. You are responsible for:
- Implementing your own backup strategy for campaign data, click data, and conversion data
- Regularly exporting critical data through the Klixsor API or admin panel
- Maintaining copies of your campaign configurations, offers, and landing pages
In the event of data loss — whether due to hardware failure, software error, account termination, or any other cause — Klixsor is not liable for lost data or the cost of data recovery.
4. Setup Fee
A one-time, non-refundable setup fee is charged at the time of purchase. This fee covers server provisioning, software installation, and initial configuration. The setup fee is non-refundable once the server provisioning process has begun, regardless of whether the customer subsequently cancels their subscription.
5. Subscription and Billing
- Cloud subscriptions are billed monthly via Stripe
- The first month may include a free trial period as indicated at checkout
- After any trial period, the full monthly rate is charged automatically
- Prices may vary by server region; regional surcharges are displayed at checkout
- You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period
6. Suspension and Termination
- If payment fails, your Cloud instance will be suspended (stopped but data preserved)
- You will have a 7-day grace period to resolve payment issues
- After the grace period, your instance will be permanently terminated and all data deleted
- We may suspend or terminate instances that violate our Acceptable Use Policy
- We reserve the right to terminate any Cloud instance at our discretion with reasonable notice
7. Access and Security
- You will receive admin panel credentials via email upon instance activation
- You are responsible for the security of your admin credentials
- We recommend changing the default admin password immediately after first login
- Cloud instances are configured for admin panel access only; direct server (SSH) access is not provided
- We reserve the right to access your instance for maintenance, updates, and troubleshooting purposes
8. Updates and Maintenance
We may perform software updates and system maintenance on your Cloud instance at our discretion. Updates may include:
- Klixsor software updates (new features, bug fixes, security patches)
- Operating system security patches
- Database maintenance
We will make reasonable efforts to minimize disruption, but updates may cause brief periods of downtime. We are not obligated to provide advance notice of routine updates.
9. Limitations
- Cloud instances are subject to the resource limits of the selected plan (CPU, RAM, storage)
- Excessive resource usage may result in degraded performance
- We do not guarantee specific performance metrics
- The Cloud Service is subject to the same Acceptable Use Policy as the self-hosted software
10. Liability Limitation
To the maximum extent permitted by law, our total liability for the Cloud Service shall not exceed the amount you paid for the Cloud Service in the three (3) months preceding the claim. We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from use of the Cloud Service.
